Are You Eligible for Workers' Compensation Benefits?

Protecting the Rights of Workers in Pennsylvania

When workers are injured on the job, workers' compensation can provide coverage for medical benefits, wage-loss replacement, specific loss awards for permanent disability and disfigurement, and death benefits for dependents. Obtaining workers' compensation benefits can be a lengthy, complex process, however. The regulations are confusing and your employer's insurance carrier will work hard to limit the company's expenses and the benefits you are entitled to.

At Kenneth R. Schuster & Associates, P.C., we can assist you with workers' compensation denials. As experienced trial lawyers, we have the skill to negotiate or litigate your claim. We can also answer your questions about qualifying for benefits. To schedule a free consultation, please call our Media office at 610-892-9200.

Disability Benefits Qualification

The first step in receiving workers' compensation benefits is to correctly file your claim. There are strict deadlines for filing. For an injury caused by an accident, you should notify your employer within 120 days of the accident. Occupational diseases must occur within 300 weeks of the last date of employment in the job that caused the disease. Claims must be filed within three years from discovering the disease.

The majority of workers' comp claims are initially denied. If your claim was denied, don't give up. In most cases, our attorneys are able to determine the problem with the claim and work to resolve it. The problem can often be resolved by submitting the correct accident information and medical evidence. We understand Pennsylvania workers' compensation law and know what type of information the state workers' compensation board requires.

We are dedicated to helping injured workers get the workers' compensation benefits they need. Being out of work and unable to support your family is a frustrating experience. Our workers' comp lawyers strive to reduce your stress and make the claims and appeals processes easier.
