There is no average settlement figure for a surgical workers comp claim, and anyone quoting one is guessing. What decides it is whether surgery has happened or is still coming, what permanent restrictions follow, and whether the Compromise and Release closes your future medical treatment.
Why there is no average
Two people with the same operation can settle for very different amounts, because the number is driven by wage rate, time out of work, permanent restrictions, remaining exposure and the strength of the medical evidence, not by the procedure code.
Sites that publish an average settlement for a given surgery are producing traffic, not valuation.
Before or after matters enormously
| Timing | What you are really deciding |
|---|---|
| Before surgery | Whether to take on the cost and risk of the operation yourself. A C and R normally closes future medical, so the surgery becomes yours to fund |
| After surgery, before maximum improvement | You still do not know the outcome. Some people recover fully, some need revision, and settling now prices an unknown |
| After recovery has plateaued | The clearest position. Restrictions are known and future needs can be estimated properly |
What a surgical claim should be valued against
- The cost of the surgery itself if it has not happened, at the level actually charged rather than a notional figure.
- Post operative care: therapy, imaging, injections, medication.
- Revision risk. Fusions, joint replacements and shoulder repairs all carry realistic revision rates over a lifetime.
- Hardware removal, where applicable.
- Permanent restrictions and what they do to earning capacity.
- Any specific loss entitlement for permanent loss of use.
- Whether a third party claim exists, which changes the whole picture.
Why offers appear when surgery is proposed
Because the insurer’s reserve has just increased. An offer arriving the week a surgeon recommends a fusion is a response to their exposure, not to your recovery. It is a reasonable moment for them to try, and a poor moment for you to accept without analysis.
Medicare and set asides
Where you receive Medicare or expect to, future injury related treatment has to be accounted for, sometimes through a set aside. In a surgical claim with likely future care this is usually the step that determines the timetable.

Questions people ask us about this
What is the average workers comp settlement for surgery in Pennsylvania?
There is not one, and any figure quoted as an average is guesswork. Settlements are driven by wage rate, time out of work, permanent restrictions, future medical need and the strength of the medical evidence, not by the type of operation.
Should I settle before or after my surgery?
Usually after recovery has plateaued, because that is the only point at which restrictions and future needs are known. A Compromise and Release normally closes future medical, so settling beforehand means funding the operation and the recovery yourself.
They offered right after surgery was recommended. Is that a good sign?
It is a sign their reserve just increased. The timing responds to their exposure rather than to your recovery. It is a reasonable moment for them to try and a poor moment to accept without valuing what the surgery and its aftermath will cost.
What should the settlement include for future care?
The surgery if it has not happened, post operative therapy, imaging, injections and medication, realistic revision risk for fusions and joint replacements, hardware removal where applicable, and the effect of permanent restrictions on earning capacity.
Why is my settlement being delayed by Medicare?
If you receive Medicare or expect to soon, its interest in future injury related treatment must be considered, sometimes through a set aside arrangement. In a surgical claim with likely ongoing care this is usually what sets the timetable rather than any disagreement about the amount.
