If your long term disability coverage comes through your employer it is almost certainly governed by ERISA. That means the internal appeal, usually with a 180 day deadline, is where the case is won or lost, because a court will generally review only the evidence already in the insurer file.

Why the appeal matters more than the lawsuit

Under ERISA, if the insurer denies you and you sue, the judge generally considers only the administrative record, the evidence already in the insurer’s file. You cannot walk into court with a new specialist report. Many judges also apply a deferential standard, asking whether the denial was unreasonable rather than whether it was right.

So everything a court will ever see has to go in during that 180 day window. People who file a two page appeal themselves and hire a lawyer after it fails have usually already lost, and nothing can be added afterwards.

What a proper appeal contains

  • A treating specialist’s opinion addressing function, not just diagnosis.
  • A functional capacity evaluation where the restriction is physical.
  • Neuropsychological testing where cognition is affected.
  • A vocational assessment addressing the policy’s actual definition of disability.
  • Statements from people who see you daily.
  • A response to whatever the insurer’s file reviewer said, point by point.
  • The complete claim file, which you are entitled to request and which frequently reveals the reviewer’s instructions.

The 24 month cliff

Most policies pay for the first 24 months if you cannot perform your own occupation, then switch to a stricter test of whether you can perform any occupation for which you are reasonably qualified.

An enormous proportion of terminations happen at exactly that point. Nothing medical changed. The definition did. Diary the date at the outset, because preparing for it in advance is far more effective than reacting after the letter arrives.

Mental health and self reported limits

Many policies cap benefits for mental health conditions, commonly at 24 months, and dispute conditions without objective imaging. Fibromyalgia, chronic fatigue and chronic pain claims are routinely denied for insufficient objective evidence.

They are winnable, on documentation: consistent treatment, functional testing, detailed daily activity records and specialist opinions that address function rather than repeating a diagnosis.

Surveillance

Expect it, and expect social media review. The answer is not to hide but to be accurate about variability: what you can do on a good day, what it costs you afterwards, and what you cannot sustain. A person filmed carrying shopping who told the insurer they can never lift has a problem even if both statements were true on different days.

Questions people ask us about this

How long do I have to appeal a long term disability denial?

Generally 180 days for an ERISA governed plan, which covers most employer provided coverage. That appeal is not a formality: it is the point at which the record closes, and a court will usually consider only what is already in the insurer's file.

Why can I not just sue?

You can, but under ERISA the judge generally reviews only the administrative record and often applies a deferential standard. New evidence is not admitted. That is why a thin self filed appeal followed by hiring a lawyer is the sequence that loses these cases.

My benefits stopped at two years and nothing changed medically.

Most policies pay for 24 months if you cannot do your own occupation, then apply a stricter any occupation test. A very large share of terminations happen at exactly that point. It is a definition change rather than a medical finding, and it is appealable.

They said there is not enough objective evidence.

That is the standard denial for conditions that do not show on imaging, including fibromyalgia, chronic fatigue and chronic pain. These claims are won on documentation: consistent treatment, functional capacity testing, detailed daily activity records and specialist opinions addressing function rather than restating a diagnosis.

Can I get the insurer's file?

Yes, you are entitled to request the complete claim file, and it is one of the more useful things to obtain. It frequently reveals what the file reviewing physician was asked, what records they were and were not sent, and how the decision was actually made.

Are they watching me?

Assume surveillance and social media review. The answer is accuracy about variability rather than avoidance: what you manage on a good day, what it costs afterwards, and what you cannot sustain. Absolute statements are what video contradicts.
